An Enduring Power of Attorney allows you to appoint one or more persons of your choice to make decisions on your behalf in the future in the event that you become mentally incapacitated and you are unable to manage your affairs.  The person or persons you choose will be known as your attorney(s). The Enduring Power of Attorney is entered in to while you are mentally capable and it is intended to come in to effect only if you become mentally incapable.   By entering in to an Enduring Power of Attorney you can organise your affairs in advance of mental incapacity.

The Enduring Power of Attorney provides a mechanism for you to manage your assets and affairs with a view to your proper care in the event that you become mentally incapacitated.  When creating the Enduring Power of Attorney you can decide the scope of the authority to be given to your attorney(s).  You can give your attorney(s) the authority to manage your property and affairs and you can also include the authority to make personal care decisions.

In the event that you become mentally incapacitated and no Enduring Power of Attorney is in place, an application may be necessary to have you made a Ward of Court so that your assets and property can be managed.  However the person appointed to manage your affairs in those circumstances, known as the Committee, will be appointed by the High Court.
